  • Device information
    • Purpose of collection: to load the Site accurately for you, and to perform analytics on Site usage to optimize our Site.
    • Source of collection: Collected automatically when you access our Site using cookies, log files, web beacons, tags, or pixels.
    • Disclosure for a business purpose: shared with our processor Shopify.
    • Personal Information collected: version of web browser, IP address, time zone, cookie information, what sites or products you view, search terms, and how you interact with the Site.
  • Order information
    • Purpose of collection: to provide products or services to you to fulfill our contract, to process your payment information, arrange for shipping, and provide you with invoices and/or order confirmations, communicate with you, screen our orders for potential risk or fraud, and when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
    • Source of collection: collected from you.
    • Disclosure for a business purpose: shared with our processor Shopify.
    • Personal Information collected: name, billing address, shipping address, payment information (including credit card numbers, email address, and phone number.

Minors

The Site is not intended for individuals under the age of 18. We do not intentionally collect Personal Information from children. If you are the parent or guardian and believe your child has provided us with Personal Information, please contact us at the address above to request deletion.

Sharing Personal Information

We share your Personal Information with service providers to help us provide our services and fulfill our contracts with you, as described above. For example:

  • We use Shopify to power our online store. You can read more about how Shopify uses your Personal Information here: https://www.shopify.com/legal/privacy.
  • We may share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.
  • We may share your Personal Information to our logistic partners which is necessary to fulfill our delivery obligations.

Although we make every effort to ensure the security of your data, we cannot guarantee the integrity and security of your data stored with our partners.

Sending data to countries that are not members of the EU or EEA

In the case of using internet services outside the EU member states for the purpose of providing internet services, the data is sent may be transferred, stored or processed in third countries where the legislation in the area of personal data protection prescribes different standards than in EU member states, or EGP. With the use of services in countries outside EU, you agree that personal data can be transferred, or sent to entities located in third countries. Otherwise, KOLPAK DOO will not independently transfer your personal data to countries outside the EU or EEA

Behavioural Advertising

As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. For example:

  • We use Shopify Audiences to help us show ads on other websites with our advertising partners to buyers who made purchases with other Shopify merchants and who may also be interested in what we have to offer. We also share information about your use of the Site, your purchases, and the email address associated with your purchases with Shopify Audiences, through which other Shopify merchants may make offers you may be interested in.

    Using Personal Information

    We use your personal Information to provide our services to you, which includes: offering products for sale, processing payments, shipping and fulfillment of your order, and keeping you up to date on new products, services, and offers.

    Lawful basis

    Pursuant to the General Data Protection Regulation (“GDPR”), if you are a resident of the European Economic Area (“EEA”), we process your personal information under the following lawful bases:

    • Your consent;
    • The performance of the contract between you and the Site;
    • Compliance with our legal obligations;
    • To protect your vital interests;
    • To perform a task carried out in the public interest;
    • For our legitimate interests, which do not override your fundamental rights and freedoms.

    Retention

    When you place an order through the Site, we will retain your Personal Information for our records unless and until you ask us to erase this information. For more information on your right of erasure, please see the ‘Your rights’ section below.

    If you want to close your user account of the online store or mobile application, you can do so at any time in the settings tab of your user account (in accordance with the instructions on the website that are updated from time to time) by sending a request to close the user account to the contact address. Proof of identity and address must be attached to the written request. Closing the user account of the online store does not mean revocation of consent (unsubscribe) from receiving notifications and direct marketing. Take into account the fact that some personal data about you that we process on the basis of the contract may not be deleted in accordance with the regulations in the area of tax law and we store them for 10 years from the receipt of the order, i.e. the resolution of the complaint or the return of the product. At the same time, you must be aware that your posts from the times of the active user account remain visible even after closing the user account

    Automatic decision-making

    If you are a resident of the EEA, you have the right to object to processing based solely on automated decision-making (which includes profiling), when that decision-making has a legal effect on you or otherwise significantly affects you.

    We DO engage in fully automated decision-making that has a legal or otherwise significant effect using customer data.

    Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you.

    Services that include elements of automated decision-making include:

    • Temporary blacklist of IP addresses associated with repeated failed transactions. This blacklist persists for a small number of hours.
    • Temporary blacklist of credit cards associated with blacklisted IP addresses. This blacklist persists for a small number of days. 

    Your rights

    If you are a resident of the EEA, you have the right to access the Personal Information we hold about you, to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased.     Your Personal Information will be initially processed in Ireland and then will be transferred outside of Europe for storage and further processing, including to Canada and the United States.     Right of access to data

    An individual can request at any time that the company KOLPAK DOO confirms to him whether data is being processed in connection with him, if they are processed, to enable access to personal data as well as to provide him with information related to the processing of his personal data (e.g. on the purpose of processing, type of personal data, users, to whom they were or will be sent personal data, the intended period of data storage, about technical and organizational measures for data protection and fig.).

    Right to rectification

    An individual can request at any time that the company KOLPAK DOO enables him to correct incorrect personal information data related to him and supplementing incomplete personal data. Registered users can do this through their user account settings in the online store.

    Right to erasure

    In accordance with the conditions as determined in more detail by the applicable regulations, an individual can at any time request that the company KOLPAK DOO enables the right to delete personal data (the so-called right to delete).

    Right to restriction of processing

    In accordance with the conditions as determined in more detail by the applicable regulations, an individual can at any time request that the company KOLPAK DOO enables the right to limit the processing of your personal data. Registered internet users service providers can do this in their user account settings. It is necessary to take into account that in the case of restrictions the processing of certain personal data may not be possible ensure full service.

    Right to data portability

    An individual can at any time request that the company KOLPAK DOO enable him to provide personal data in sent to an individual in a structured, commonly used and readable form or can be transferred to an operator of choice of an individual (if technically feasible) under the conditions specified in more detail by applicable regulations.

    The right to object

    In the event that the company KOLPAK DOO processes personal data based on the legal interests of the company KOLPAK DOO, as shown above, an individual can in certain cases object to such processing.

    The company KOLPAK DOO will stop processing this personal data, unless it assesses that it has well-founded i legitimate reasons for continuing processing or if processing is required for legal reasons.

     

    An objection against the processing of personal data for the purposes of direct marketing can also be made with the withdrawal of consent to receive notifications by clicking on the 'unsubscribe' button at the bottom of the electronic message, or to follow instructions in the notification sent.

     

    Withdrawal of consent

    An individual can revoke consent at any time, in cases where he has given consent for a particular purpose of processing your personal data. Registered users can revoke their consent in their account settings. The revocation of consent does not affect the legality of the processing of personal data that was carried out until its revocation.

    The right to appeal to a supervisory authority

    The individual has the right to submit a complaint - to the competent authority of the market where the retail store is located company: Agency for Personal Data Protection and Free Access to Information of Montenegro if it considers that his personal data is processed in violation of the applicable regulations governing the protection of personal data. Procedure of filing a complaint with the supervisory body is published on the website of the supervisory body.
